1. Acceptance of Terms
By registering for or using Card Trade, you agree to these Terms of Use. If you do not agree, you may not access or use Card Trade.
2. Eligibility
Card Trade is for collectors 18 years and older only. By creating an account, you represent that you are at least 18 years old and legally able to enter into this agreement.
3. Limited License
Card Trade grants you a revocable, non-transferable, limited license to use the app and its services solely for personal, lawful, and non-commercial collecting activity.
4. Account Responsibilities
– You must maintain accurate, current, and complete information.
– You are responsible for maintaining the confidentiality of your login credentials and referral codes.
– You are responsible for all activity under your account.
– Accounts are personal and may not be transferred or shared.
5. Community Guidelines
All users must follow the Card Trade Community Guidelines, which are incorporated by reference. Failure to follow them may result in suspension or termination at Card Trade’s sole discretion.
6. User Content
– You may upload information such as card images, feedback, and messages.
– You grant Card Trade a license to use such content only as necessary to operate the platform.
– Marketing use of content will require your opt-in consent.
7. Prohibited Uses
You may not:
– Use Card Trade for unlawful purposes or prohibited items.
– Engage in scams, fraud, counterfeit, or misrepresentation.
– Create fake deals to inflate reputation scores.
– Reverse engineer, scrape, or use bots to interact with the platform.
8. Transactions and Responsibilities
– Card Trade is not a payment processor, escrow service, or financial institution.
– All deals and payments occur strictly between users.
– Only deals documented fully within Card Trade are eligible for mediation or Scam Protection coverage.
– All communications and records related to a deal must remain inside Card Trade to be valid.
9. Disputes Between Users
– Disputes must be raised within 30 days of deal completion.
– Both parties must provide documentation (e.g., shipping proof).
– If the shipper cannot provide tracking and delivery confirmation, Card Trade may rule in favor of the buyer.
– Sellers are responsible for packaging cards securely and using the agreed-upon shipping service. If a package is lost in transit, the seller must refund the buyer and pursue reimbursement from the courier.
– Card Trade may mediate disputes but is not responsible for enforcement beyond its stated policies.
10. Feedback & Reputation
– Feedback after each deal is mandatory.
– Feedback is permanent and cannot be removed except if it violates Community Guidelines.
– Card Trade owns feedback and reputation data.
11. Membership Fees
– All membership fees and prepaid subscriptions are non-refundable, except where required by law.
– Cancellation stops future renewals but does not entitle you to a refund.
12. Intellectual Property
– All trademarks, software, designs, and content are the property of Traid Safe Inc.
– Users receive no ownership rights and may not use Card Trade’s IP without written permission.
13. Service Changes
Card Trade may modify, suspend, or discontinue features or the platform at any time without liability.
14. Termination
Card Trade may suspend or terminate your account at its sole discretion for any violation or risk to the platform.
15. Legal Cooperation
Card Trade may disclose user data if required by law, subpoena, or investigation.
16. Disclaimers & Limitation of Liability
– Card Trade is provided “as is” and “as available.”
– No warranties of merchantability, fitness, or availability are given.
– Card Trade’s liability is limited to the amount you paid in membership fees during the 12 months prior to the claim.
– Card Trade is not responsible for indirect or consequential damages.
17. Indemnification
You agree to indemnify and hold harmless Traid Safe Inc. and its officers, employees, and affiliates from any claims, damages, or expenses arising from your use of Card Trade.
18. Arbitration & Class Action Waiver
– All disputes will be resolved by binding arbitration under the Federal Arbitration Act.
– You waive any right to participate in a class action or jury trial.
19. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law rules.
20. Modifications to Terms
Card Trade may update these Terms from time to time. Notice will be given via in-app notice or email. Continued use after changes = acceptance.
21. General Provisions
– Survival: Sections on arbitration, indemnification, liability, IP, and data retention survive termination.
– Severability: If any provision is invalid, the rest remain enforceable.
– No Waiver: Failure to enforce a right does not waive it.
– Assignment: Users may not assign rights; Card Trade may assign in a merger or acquisition.
– Language: These Terms are in English only.
