Please read these Terms of Service carefully before using CardTrade. By downloading or using the app, you agree to be bound by these terms.
1. Eligibility
You must be at least 18 years old to access or use CardTrade.
By creating an account or using the Services, you represent and warrant that:
- You are at least 18 years of age
- You have the legal capacity to enter into a binding agreement
- You are a legal resident of the United States or Canada
- All information you provide is accurate and complete
- You will comply with these Terms and all applicable laws
CardTrade may, in its sole discretion, refuse access to or use of the Services to any person at any time.
2. Account Requirements
2.1 One Account Per User
CardTrade enforces a strict one account per user policy.
You may not:
- Create or maintain more than one account
- Use false, misleading, or incomplete identity information
- Attempt to bypass or circumvent identity verification systems
CardTrade reserves the right to suspend, restrict, or permanently terminate any account that violates this policy.
2.2 Identity Verification
You agree to provide accurate and complete information for identity verification when requested.
CardTrade may require identity verification, including submission of government issued identification and biometric data, in order to:
- Access certain features
- Complete transactions
- Maintain account access
Failure or refusal to complete verification may result in limited functionality, suspension, or termination of your account.
2.3 Account Responsibility
You are responsible for:
- Maintaining the confidentiality of your account
- All activity conducted under your account
- Ensuring your contact and account information remains accurate
You must notify CardTrade immediately of any unauthorized access or suspected security breach.
2.4 Anti Circumvention and Account Integrity
To enforce its one account per user policy and protect the integrity of the platform, CardTrade may use technical measures to detect and prevent duplicate or fraudulent accounts.
You agree that CardTrade may collect and use information such as:
- Device identifiers
- IP addresses
- Phone numbers
- Identity verification data
- Behavioral and usage patterns
to identify related or duplicate accounts. Accounts determined to be associated with the same individual or used to circumvent platform rules may be restricted, suspended, or permanently terminated.
2.5 Enforcement
CardTrade may, in its sole discretion:
- Monitor accounts for compliance
- Investigate suspected violations
- Take any action deemed necessary to protect the platform and its users
This includes suspension, restriction, or permanent removal from the platform.
3. Nature of the Service
CardTrade provides a platform that enables users to document, facilitate, and complete transactions with other users.
CardTrade may offer tools and features designed to improve transaction safety, including identity verification, transaction documentation, Protected Payment, Shipping Protection, and Scam Protection.
CardTrade is not a marketplace and does not facilitate product discovery or listings. Users are responsible for finding and initiating transactions independently, including through third party platforms such as social media, messaging platforms, or other external channels.
CardTrade is not a buyer, seller, broker, agent, or party to any transaction between users.
All transactions are conducted solely between users, and users are solely responsible for:
- The accuracy of item descriptions
- The terms of the transaction
- Payment arrangements
- Shipping and delivery
CardTrade does not take possession of items and does not control or guarantee the quality, safety, legality, or delivery of any goods or services exchanged through the platform.
Platform Record Controls
CardTrade relies exclusively on the transaction details, terms, and documentation recorded within the platform.
Any communications, agreements, or representations made outside of CardTrade, including on social media, messaging platforms, or other external channels, are not considered part of the transaction record and will not be considered in any review, dispute, or decision made by CardTrade.
Users are responsible for ensuring that all relevant transaction terms are accurately documented within CardTrade.
4. Protected Payment
CardTrade may offer Protected Payment, a feature designed to facilitate the temporary holding and conditional release of funds in connection with user transactions.
Protected Payment is intended to enhance transaction safety by allowing funds to be held until certain conditions are met.
4.1 Third Party Providers
Protected Payment is facilitated through third party payment processors. CardTrade does not hold or custody funds and is not responsible for failures of third party providers.
4.2 Not a Financial Institution
CardTrade is not a bank, money transmitter, or escrow provider.
4.3 Conditional Release
Funds may be released based on platform conditions including delivery confirmation and user actions.
4.4 No Guarantee
Use of Protected Payment does not eliminate transaction risk.
4.5 Discretion
CardTrade may delay, limit, or deny fund releases where fraud or disputes are suspected.
5. Shipping Protection
CardTrade may offer Shipping Protection, a feature intended to provide users with additional protection in connection with the shipment of items related to a transaction.
Shipping Protection:
- Is not an insurance product
- Is not provided by a licensed insurance company
- Does not guarantee reimbursement
- Is a discretionary benefit subject to eligibility requirements
Shipping Protection is only available for shipments that meet CardTrade's requirements, including use of shipping labels purchased through the platform and compliance with applicable packaging, tracking, and delivery requirements.
The full terms, conditions, and requirements of Shipping Protection are set forth in the Shipping Protection Policy, which is incorporated into these Terms by reference.
CardTrade reserves the right to deny any claim and to modify or discontinue Shipping Protection at any time.
6. Scam Protection
CardTrade may offer a Scam Protection Guarantee as part of its platform.
The Scam Protection Guarantee:
- Is not an insurance product
- Is not provided by a licensed insurance company
- Does not guarantee reimbursement
- Is a discretionary program subject to eligibility requirements
- Applies only to transactions properly documented within CardTrade
The full terms, conditions, and requirements of the Scam Protection Guarantee are set forth in the Scam Protection Guarantee Policy, which is incorporated into these Terms by reference.
CardTrade reserves the right to deny any claim and to modify or discontinue the Scam Protection Guarantee at any time.
7. User Responsibilities
Users must act honestly and comply with all platform requirements.
Only information documented within CardTrade is considered valid for any review or determination.
8. Prohibited Conduct
Users may not engage in fraud, abuse, misrepresentation, or attempts to exploit platform protections.
CardTrade may take enforcement action at its sole discretion.
9. Disputes
CardTrade is not obligated to resolve disputes and may rely solely on platform-documented information.
10. Fees and Payments
Subscriptions
Auto-renew unless canceled.
No Transaction Fees
CardTrade does not charge fees to buy, sell, or trade.
Transactional Services
Includes shipping labels. CardTrade is not responsible for carrier performance.
No Refunds
All fees are non-refundable unless required by law.
11. Limitation of Liability
CardTrade is not liable for:
- User fraud
- Shipping issues
- Payment failures
- Carrier errors or delays
- Any decisions, determinations, or outcomes related to Scam Protection or Shipping Protection, including denied claims or partial payouts
Liability is capped at the greater of $100 or fees paid in the past 12 months.
12. Indemnification
You agree to indemnify CardTrade for claims arising from your actions.
13. Account Termination
CardTrade may suspend or terminate accounts at any time.
14. Data and Privacy
Use of the platform is subject to the Privacy Policy.
15. Modifications
CardTrade may update these Terms at any time.
16. Dispute Resolution and Arbitration
Disputes are resolved through binding individual arbitration.
No class actions permitted.
Users may opt out within 30 days.
17. Governing Law
Delaware law applies.
